1. This “try it risk free” offer (the “offer”) is being made by De Longhi America Inc., doing business as ‘De’Longhi,’ with offices at 2 Park Way 3rd Floor, Upper Saddle River, NJ 07458 (the “Sponsor”, “we”, “us” or “our”). If you are an eligible consumer and follow the instructions below within the time periods described, then subject to your being in compliance with all these terms and conditions, you will be able to return your qualifying De’Longhi Coffee Machine and obtain a refund of the purchase price if you are not satisfied with your purchase. A list of qualifying De’Longhi Coffee Machines eligible for this offer is below and we may refer to them as “products” in these terms and conditions.

2. You are eligible for this offer if: 
  • You are a legal resident of the United States, over the age of 18; and
  • You are a consumer (i.e., not a business or for commercial use) that purchased and paid for or will purchase and pay for any of the De’Longhi Coffee Machines listed below (the “products”) starting from Jun 15, 2023 
  • You purchased the product from De’Longhi, online at https://www.delonghi.com/en-us, as authenticated by the proof of purchase receipt (you will also receive an email from us confirming your order and payment). You cannot take advantage of this offer through or at any dealer or retailer or for purchases made anywhere else, except online as mentioned above; and 
  • You register the product at https://delonghi.registria.com/ within thirty (30) days of your purchase; and
  • You are the only person in your household that has or will apply to take advantage of this offer (i.e., only one claim per household); and 
  • You are not an officer, director or employee of ours, our parent or any of its or their subsidiaries or affiliated companies, as well as any of our or their advertising and promotional agencies, suppliers, distributors, contractors, vendors and licensees, and not an immediate family member (spouse, parents, siblings and children) or individuals residing in the same household as any these individuals.

3. We will send you an email when you complete the registration process for your product that will confirm your registration and include a “Learn More” link with all these terms and conditions that apply to the offer for your review. The email and our website will also have links to the claim form that applies to this offer to allow you to submit a claim to us.

4. The products (i.e., the De’Longhi Coffee Machines listed below) are the only ones eligible for this offer and this offer is only valid and limited to a single claim per household for purchases of these products during the promotional period. We reserve the right to discontinue selling or making any product available for sale during the promotional period. We also reserve the right to modify, suspend or even discontinue and terminate this offer and promotional period at any time. If we decide to do so, we will continue to honor the offer and not disqualify you from taking advantage of this offer, if you purchased a product and were eligible to submit a claim before these have taken effect.

5. To take advantage of this offer, you must submit your claim no earlier than 31 days after the purchase date shown on your receipt (“purchase date”), but no later than 90 days after the purchase date (which must not be more than 90 days after the promotional period ends). You can find the claim form at https://cloud.news.delonghi.com/90dayreturn and you must complete the form using the same information in your purchase receipt and your registration. You should carefully follow the instructions on how to complete your claim form since only properly completed forms that have complied with these terms and conditions will be eligible to take advantage of our offer. The claim form will ask for your name, email, birthday and order number, you will also be asked to state the reason you are returning the product. You will then be able to submit your claim online to us. If you don’t complete the form properly or any of the information you submit does not match the information you provided when you purchased the product, your claim will not be processed or approved. 

6. We are not responsible if your claim form is incomplete, unintelligible, inaccurate, misdirected or received past the claim submission deadline, as a result of any causes beyond our control. Only the time stamp recorded by our systems when your claim is received in order to take advantage of this offer, will determine whether your claim has been submitted within the required time period. Proof of submission of a claim form by you does not and will not constitute proof that it was received by us in a timely manner. 

7. If your claim form is approved, we will also include instructions telling you what you need to do to return your product, including a standard return form that you will need to print, complete and include in the packaging when you return the product to us – the information must match the information on your claim form. You will have 28 calendar days from the date we notify you to return the product as part of this offer. If your claim has not been submitted properly, we will notify you by email with instructions for returning the product to us. If the claim form is deficient, we have the right (but not an obligation) to give you an additional 3 days to supply any missing information or receipts or correct information that does not appear to match our records. Failure to comply will result in a final rejection of your claim. If we find that the product, when returned to us, is not operable, or if there are missing parts, or we find the product has been damaged we will notify you that your claim has been rejected. While we can allow you to take advantage of this offer if you are not satisfied with the product in normal use, your claim and the product will become ineligible if we don’t receive the product in good working order, undamaged.

8. You are responsible for all costs and expenses incurred to return the product to us. All care should be taken to ensure the returned product is adequately packaged and protected in transit to avoid loss or damage. We strongly recommend you arrange shipping that will allow you to insure, track and confirm delivery to us in order to substantiate your returning it and retain proof for your records. These services are available from the USPS, UPS, FedEx and other carriers. We are not responsible, nor will we have any obligation to provide any refund to you should your shipment be lost, stolen or damaged in transit and it is your responsibility, not ours, to file a claim with the carrier you used for the shipment.  

9. We are not responsible if your product is not received by us by the required deadline, whether misdirected, improperly addressed, delays in the postal service or the result of any causes beyond our control. Only the postal service postmark that appears on the packaging you use to return the product to us when taking advantage of this offer will determine whether the product has been returned within the time period required. Proof of mailing does not and will not constitute proof that it was received by us in a timely manner. 

10. IMPORTANT:  If your product is not working properly, you should contact our customer service center since that will be covered by your warranty – in that case do not submit a claim related to this offer. You should only take advantage of this offer and submit a claim form if you are not satisfied with the product based on its normal and intended use. If you return a product and we find it is damaged or in non-working condition when we receive it, we reserve the right to reject your claim entirely or process a refund in a reduced amount based on the condition of the product when we receive it and, if applicable, our estimate of its then current value or the cost to repair the product. We will notify you if that happens and provide you with the relevant details of any such determination, which shall be binding and controlling for all purposes. 

11. Subject to all these terms and conditions, if your claim is properly submitted and the product is returned to us as required in its original condition (taking into account normal use by you) we will refund the actual purchase price, plus any applicable tax you paid, as evidenced on the purchase receipt, but excluding the original charges for shipping and/or handling. We will issue a credit to you in the same form of payment you used for the purchase, and you should allow at least 14 business days for us to process any refunds. Your financial institution or payment instrument issuer may require additional time to process and post the credit to your account so you should allow 1-2 billing cycles from the day you return your product to us for the credit to be posted to your account.

12. This offer cannot be combined with any other offer or used in conjunction with any other promotion. You may not transfer or assign your rights, including, without limitation, your right to take advantage of this offer or your obligation to comply with all these terms and conditions.

13. By submitting a claim, accepting or seeking to take advantage of this offer, you are and will be agreeing to accept all of these terms and conditions and be legally bound by them. 14. In the event of any dispute, matter involving the interpretation of any terms or conditions or the exercise of any decision, determination or judgment applicable to the offer and these terms and conditions, the Sponsor’s decision is and shall be final and binding for all purposes.

15. Information you submit as part of the claim process and otherwise in connection with this offer, will be used for the sole purpose of administration of the offer and the claims process and we will not disclose your information except as necessary to operate the offer and claims process as described above or as may be required by law. Any choices you have made regarding our use of your information outside of the offer described above remains separate and unaffected by these terms and conditions. 16. These terms and conditions shall be governed by, construed and enforced under the laws of the State of New Jersey and the Federal laws of the United States applicable therein, without regard to any conflict of laws considerations that might cause the application of any other laws.  By submitting or attempting to submit a claim or take advantage of this offer, you unconditionally and irrevocably submit to the personal jurisdiction of the State and Federal courts located in the State of New Jersey and waive any right you may have that such courts lack jurisdiction or that they are an improper or inconvenient forum agreed to exclusively have the right to hear and adjudicate all matters related to the offer and these terms and conditions.
