“De’Longhi Together” Programme (UK)
Terms and Conditions
1. These Terms and Conditions
These regulations set out the general terms and conditions (the “Terms and Conditions”) under which Kenwood Limited, with registered office at 1 Kenwood Business Park, New Lane, Havant, Hampshire PO9 2NH and registration number 00872044 (the "Company" or “We”) allows its end consumers to participate to the “De’Longhi Together” Programme as hereinafter described.
1.1. Kenwood Limited is a company of the De’Longhi Group who provides the technology, support and administration services (the "Services") to run the “De’Longhi Together” programme (the “Programme”) through which the Company offers their consumers the benefits in the form of discounts hereinafter specified under clause 2 ("Referral discounts").
The Company’s end consumers eligible to join the Programme as Referrers (as hereinafter defined) and to redeem the Referral discounts can be:
a) customers who have purchased a De’Longhi coffee machine on the following website: https://www.delonghi.com/en-gb (hereinafter, “De’Longhi Website”);
b) customers who have purchased a De’Longhi coffee machine from a retailer and registered it on De’Longhi Website https://www.delonghi.com/en-gb/product-registration (including a valid proof of purchase) (hereinafter, the “Customers”).
This Programme consists of:
1.1.1 refer-a-friend services where Customers are offered Referral discounts in exchange for those existing Customers ("Referrers") referring their friends ("Referred Friends") to De’Longhi Group’s products or services; and
1.1.2 Referred Friends are offered incentives to purchase a specific selection of De’Longhi Group’s products or services.
1.2. These Terms and Conditions apply to individuals who are accessing or using the Programme as a Referrer, a Referred Friend and the use of "User" or "you" shall be a reference to any of these terms as the context permits.
1.3. By participating in the Programme and using the Services, Users agree to these Terms and Conditions. If you do not agree to these Terms and Conditions in their entirety, you should not participate in the Programme in any manner. Users may not participate in the Programme were doing so would be prohibited by any applicable law or regulations.
1.4. We reserve the right to modify or amend at any time these Terms and Conditions. Any amendments or new terms and conditions will be available on our Website and/or via the landing page of the Website where the relevant Programme is being offered. The Terms and Conditions that apply to you shall be the Terms and Conditions published at the time you participate in the relevant Programme.
1.5 The Company shall be entitled to stop or suspend the Programme or to refuse the issue of any Referral discount to any Referred Friend or Referrer at any time.
1.6 The Company shall also be entitled to vary any and all elements of the Programme, including but not limited to the discount percentages and / or the effective and applicable date of the promotion and the applicable date provided by the Programme, at any time without notice.
1.7 If either the Referrer or the Referred Friend makes use of their right of withdrawal under consumer law, no Referral discount will be granted, neither to the Referrer, nor to the Referred Friend.
1.8: The “De’Longhi Together” Program cannot be combined with any other price discounts from the Company.
2. Referral discount
These are the key conditions to redeem the Referral discount.
2.1. Referrer Referral discount
For each Referred Friend who orders for the first time, the Referrer is offered:
(i) 30% discount on the sale price of a specific selection of products consisting of: coffee machine accessories, maintenance products and coffee beans categories as available on the following web page: https://www.delonghi.com/en-gb/c/coffee/accessories-e-care.This 30% discount cannot be applied to subscription products, can be used only for one order of the above indicated products and cannot be combined with any other discount; and(ii) 20% discount on the Referrer first purchase on any of the following websites: www.kenwoodworld.com/en-gb, www.braunhousehold.com/en-gb, (the “Websites”); For each Website, the following exclusion apply:1. www.kenwoodworld.com/en-gb: stand mixer attachments, stand mixer accessories as well as any product with the labels CONFIGURABLE or NEW are excluded;2. www.brandhousehold.com/en-gb: hand blender attachments as well as any product with the label NEW are excluded;
In order for the Referrer to qualify for the Referral discounts, the Referred Friend must meet the conditions provided for under following clause 3.5. (The Referrer and the Friends referred must not be the same, must not belong to the same household, nor share the same shipping address)
In order to share this offer the Referrer must be over the age of 18.
Multiple referrals are allowed but subject to the following limits: a Referrer may not earn more than 5 (five) discounts within any 30-day period or 25 (twenty five) within the last 12 months. A Referrer should not expect their Referred Friends to be given Referral discounts automatically if they are in breach of the above limitations.
Referral discounts will be provided to the Referrer within 5 (five) working days after the Referred Friend's purchase.
The Referrer will be notified by email once a Referred Friend has purchased and when the Referral discount has been earned.
Referral discounts will be valid for 3 (three) months from the date they are earned by the Referrer.
Referral discounts cannot be combined with each other nor with other discount codes in a single order and cannot be exchanged for cash or other discounts.
2.2. Referred Friend Referral discounts:
The Referred Friends will receive a 20% discount on the Referred Friend first purchase on UK De’Longhi Website of a specific selection of coffee makers including: automatic coffee makers, manual espresso makers, Nespresso coffee machines and Dolce Gusto coffee machines (hereinafter, the “Eligible Products”). for Dolce Gusto coffee machines: https://www.delonghi.com/en-gb/c/coffee/coffee-machines/capsules-coffee-machines/nescafe-dolce-gusto-coffee-machines (hereinafter, jointly referred to as the “Eligible Products”).Such 20% discount can be used only for one order of the above described Eligible Products and cannot be combined with any other discount; products with the label NEW are excluded.Referred Friend discounts cannot be combined with each other nor with other discount codes in a single order and cannot be exchanged for cash or other discounts.
The Referred Friend discount is valid for 30 (thirty) days from the date of joining the Program.
In order to qualify for the discount, the Referred Friend must be a new Customer to De'Longhi, over the age of 18 and meet the conditions provided for under following art. 3.5.
The Referred Friend discount cannot be claimed by the same person making the referral.
Referred Friend discounts cannot be combined with other discount codes in a single order and, in any case, cannot be exchanged for cash or other discounts.
There are limits in place on how many and how frequently referrals can be made by any single Referrer as set out in clause 2.1.d). discounts may not be given to the Referred Friend if those limits are exceeded.
3. The Programme
3.1. The Programme, and your participation in it, is also subject to the General Terms & Conditions of Sale of www.delonghi.com/en-gb which are available on the webpage https://www.delonghi.com/en-gb/terms-and-conditions
3.2. Unless otherwise communicated, the Company will send an e-mail inviting consumers who have purchased a Product in accordance with the rules set out in clause 1.1 and who have consented to be informed of marketing activities. Each Referrer will be provided with a unique link to share with their friends to participate in the Programme.
3.3. By agreeing to these Terms and Conditions and participating in this Programme you confirm that:
3.3.1. You are at least 18 years old;
3.3.2. all of the information you have or will provide to the Websites during receipt of the Services is true and accurate; and
3.3.3. You are responsible for configuring and maintaining your hardware, software and network connection to enable you to access the Program Services
3.4 You agree that you will not, whilst using the Programme Services:
3.4.1. use the Services for any illegal or immoral purposes, or for any purpose other than your participation in a Programme;
3.4.2. use the Services in any way that interrupts, damages or impairs them, or otherwise renders the Services less efficient;
3.4.3. impersonate any other person (living or dead), misrepresent your connection with a person or entity, or provide false or otherwise misleading information; and
3.4.4. access or attempt to access the accounts of other users or to penetrate or attempt to penetrate the security measures of the Programme.
3.5. When you send a communication to a Referred Friend, you confirm that:
3.5.1. any such Referred Friend is personally known to you;
3.5.2. You have, where reasonably practical, obtained the consent of the Referred Friends before contacting them;
3.5.3. You understand that you are the sender of all communications under the Services, and you should comply with all applicable laws in relation to the sending of electronic communications; and
3.5.4. You will not enter or otherwise use information of any third party or Referred Friend in order to use the Services for any bulk email distribution, distribution to strangers, use on social media or any other promotion of a personal link in a manner that would constitute or appear to constitute unsolicited commercial email or "spam".
3.6. For a Referrer to qualify for a discount, a Referred Friend must:
3.6.1. not be a current Customer and have never been a Customer of the Company under any email address or alias;
3.6.2. be over the age of 18 and must meet the conditions of their discount;
3.6.3. have purchased an Eligible Product within 30 (thirty) days after joining the “De’Longhi Together” Programme;
3.6.4. not cancel the order or return the Eligible Product purchased, otherwise the Referrer will no longer be eligible for the discount. and
3.6.5. comply with any other criteria notified to it.
3.7. If we reasonably believe that you have breached any of these Terms and Conditions, we reserve the right to immediately suspend or terminate your use of the Services without notifying you, and without further liability to you, including without any liability in respect of you no longer being able to participate in or benefit from any Programme.
3.8. We will not charge you a fee for receiving the Services.
3.9. We reserve the right to suspend or terminate the provision of some or all Services in respect of the Programme (whether generally or in respect of a specific User) at any time if we reasonably consider that such suspension of the Services is necessary.
4. Our Obligations to You
4.1. Our obligations to You under these Terms and Conditions are limited to using commercially reasonable endeavours to provide the Services to you in respect of the Programme.
4.2. Please be aware that internet transmissions are never completely private or secure and that any message or information you send may be read or intercepted by others, even if there is a special notice that a particular transmission is encrypted.
4.3.We will update and communicate with the Customers on the status of their referrals by email.
4.4 We will endeavour answer any questions you may have regarding this programme however any decisions made are at the Company’s sole discretion and are final.
5. Data Protection
5.1. All personal data (including, without limitation, your name, telephone number, email address and postal address) held in connection with and for the purposes of administering the Programme (the "Personal Data" ) by the Company is dealt with strictly in accordance with our Privacy Policy, a copy of which can be viewed at www.delonghi.com/en-gb/privacy-policy .
6. Web pages used to provide the Services
6.1. You are responsible for configuring your information technology, computer programmes and platform to access our site. You should use your own virus protection software.
6.2. You must not misuse the Programme by knowingly introducing viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful. You must not attempt to gain unauthorised access to our site, the server on which our site is stored or any server, computer or database connected to our site. You must not attack our site via a denial-of-service attack or a distributed denial-of service attack.
6.3. Web pages we operate, may contain links to other independent web pages which are not operated by nor under the control of De’Longhi and we are not liable for, and give no warranty or guarantee of any sort, that we have checked, screened or approved their content or their privacy policies in any way.
7. Intellectual Property Rights
7.1. The Services, and all information and materials contained on or in them, and all intellectual property rights which are expressed or embodied in any of them are the property of De’Longhi or our licensors, and nothing in these Terms and Conditions is intended to transfer any rights in any of them.
7.2. You agree that any comments, communications, ideas or other materials or information ("Customer Suggestions") that you may provide to us through or in relation to the Services and the Website is provided on a non-confidential basis. Furthermore, you agree that any Customer Suggestions you provide will be deemed to be our property once supplied to us and you assign all and any intellectual property rights that may exist in the Customer Suggestions to us. We will be under no restriction in relation to the Customer Suggestions and may use it as we see fit.
8. Our liability
8.1. No part of these Terms and Conditions are intended to exclude or limit in any way our liability to you where it would be unlawful to do so. This includes our liability for:
8.1.1. death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors; or
8.1.2. fraud or fraudulent misrepresentation.
8.2. We will not be liable to you for any financial or economic loss or for any consequential or indirect loss such as loss to reputation, lost bargain, lost profit, loss of anticipated savings or lost opportunity arising as a result of or in connection with your participation in the Programme (whether suffered or incurred as a result of our negligence or otherwise).
8.3. No part of these Terms and Conditions are intended to affect your legal rights.
9. General
9.1. We may assign or sub-contract any of our rights or obligations under these Terms and Conditions.
9.2. If any provision of these Terms and Conditions is prohibited by law or judged by a court to be unlawful, void or unenforceable, the provision shall, to the extent required, be severed from these Terms and Conditions and rendered ineffective as far as possible without modifying the remaining provisions of these Terms and Conditions and shall not in any way affect any other circumstances of or the validity or enforcement of these Terms and Conditions.
9.3. The agreement between you and the Company under these Terms and Conditions is personal to you and may not be transferred by you to any third party.
9.4. These Terms and Conditions are governed by the laws of England and Wales and the User agrees that any dispute (contractual or non-contractual) arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales
